MEMBERSHIP AGREEMENT
Welcome! We congratulate you on becoming a member of The BBG Health Club, (hereafter also referred to as the “club”, or “BBG, Inc.”). To help ensure your safe use and enjoyment of our facilities, we have established the following rules and regulations that we require everyone to follow. Please note that from time to time we may find it necessary to amend or add to these rules and regulations. Rules and regulations may also be orally communicated to you or contained on signs posted in the club. Please review and familiarize yourself with them. Please contact your club staff or manager if you have any questions.
Every member is a guest and shall be treated as such. We require that our members respect each others’ limits and boundaries. Obnoxious and outrageous behavior is grounds for immediate and permanent expulsion. Every member deserves to be treated with respect from our employees and other members and deserves a clean, well-kept facility. We implore you to let us know if you feel The BBG Health Club has not lived up to your expectations.
SIMPLY STATED
If it is illegal outside of the club, then it is not allowed inside the club.
Additionally, basic respect, courtesy, and consideration of others, staff, club property, equipment, and club environment in both your conduct and attitude is always appropriate and MANDATORY.
HOURS OF OPERATION: BBG Health Club is open 24 hours, 7 days. It is always monitored by video surveillance as it is an unmanned facility during portions of the day. These hours may be changed at the club's discretion.
MEMBERSHIP RESTRICTIONS: All members must be male and 18 years of age or older. Minors are not permitted in the club. Membership fees are non-refundable and non-transferrable. The obligation to pay dues is not dependent on the availability of all the club’s facilities. Special engagements, repairs and maintenance of some facilities may make it necessary for the club to restrict use of, or close, one or more of the facilities. Dues will not be reduced or suspended during the time when one or more of the facilities are not available.
CHECKING IN: You must register online to become a member before entering the club. Members must have an up-to-date membership, which provide an up today access on the mobile device app to enter the 2 locked doors to enter the club. Valid membership cards are always required to be a member and gain access to the club. There are several Membership plans available. Members may not loan or transfer their membership cards to anyone. Members must be in good standing (that is, paid to date) to use the club. A fee may be charged to replace lost or stolen membership cards if a second keypad card is required. Regrettably, we do not offer free tours of our facility. For the privacy of our members, you must buy membership of our club to be admitted into the club. Some membership plans will allow a member to bring a guest, but the member must register the guest to assure who is entering the club. We reserve the right to refuse service or deny entry to anyone for any reason, regardless of membership status. The bringing in of an unregistered guest or non member in violation of these rules is grounds for the immediate revocation of your membership without refund. In addition to the foregoing the club reserves the right to evaluate members at any time and may, in its sole discretion, revoke the membership of a member found to be in violation of our policies at any time for any reason without a refund!
At the time of entering the Club the member will use his access code which is monitored to access both entry doors. Members should allow the first door to close then access the second door. This maintains club security of nonmembers having access to the club. Use of lockers is on a first come first serve basis. Visits to the club are limited to a 16-hour maximum and cannot return for an 8-hour period (violating this timeframe will result in membership being revoked).
All bags are subject to inspection. Prohibited items include but are not limited to food, beverages, alcohol, drugs, glass, weapons and other contraband. Persons suspected of being under the influence of, or found to be in the possession of drugs or alcohol, will be refused entry or ejected from the club without a refund. & possibly turned over to the authorities.
MEMBER'S RESPONSIBILITY AS TO USE OF THE CLUB: You should consult with your physician before using our services and facilities. You understand and acknowledge that we have no expertise in diagnosing, examining or treating any medical condition. You agree you will not use the facilities with any medical condition, including open cuts, abrasions, sores, infections, maladies or inability to maintain personal hygiene, if such a condition poses a direct threat to the health or safety of yourself and others and agree you will use the facilities in accordance with all applicable public health requirements. It is your responsibility to consult with your physician to determine if any of these medical conditions exist and, if so, whether such conditions pose a direct threat to the health or safety of yourself or others. The Club reserves the right, however, to make the final determination in this regard.
Members who do not observe club rules and regulations or who abuse club equipment in any fashion will be asked to leave. The club and management reserve the right to terminate membership to anyone who refuses to observe any of the clubs rules or regulations without refund. Further, members are expected to behave and use club facilities in such a way that does not compromise the reputation, character, public image, or enjoyment of the club for other members.
DRESS CODE We reserve the right to deny use of the club to any person whose attire we do not consider to be appropriate in connection with the public image of our club and our rules and regulations. Signs are posted in the club regarding required attire.
Shower shoes or sandals are recommended in all wet areas: no other type of footwear is permitted. Athletic shoes are required in exercise areas. No sandals are allowed in the exercise area. No personal effects such as jackets or gym bags are permitted in the exercise, spa, sauna, or steam room areas. If you wish to carry beverages with you during your visit, you must use a covered plastic container.
LOCKER ROOM Lockers are available for daily use only by members. We recommend that members do not bring valuables into the club and that each member uses a padlock, (supplied by members), to secure their locker while using the club facilities. DO NOT LEAVE VALUABLES UNPROTECTED. WE ARE NOT RESPONSIBLE FOR LOST OR STOLEN ARTICLES. Pursuant to your membership agreement, you have waived any right to legal action against the club for lost or stolen articles. Only member locks are to be used. If member locks are not removed after membership has expired the lock will be removed and all belongings held in lost and found for 30 days then discarded, We accept no responsibility for articles left behind. Club personnel are not allowed to accept responsibility for personal articles.
GYM, STEAM ROOM, SAUNA, AND SPA No body oils or creams (suntan, baby oil, etc.) are permitted in the gym or wet areas. No shaving is permitted in the steam room, spa or sauna. Members must shower with soap and hot water before entering wet areas. For your personal hygiene, you should also shower after using the gym, steam room, sauna or spa. No diving, racing, running, horseplay, eating, drinking or personal grooming is permitted in the gym, steam room, sauna or spa. No glass containers are permitted. DO NOT USE gym or wet areas if you are taking any medication that causes drowsiness or have any medical condition which makes such use inappropriate. Please follow all posted signs carefully.
All equipment must be used as designed. If you are not familiar with the use of club equipment, please arrange for instruction with a staff member. Instruction is available to members as part of your membership. Members must be familiar with and observe club rules and regulations posted in each area. Members are required to use paper towels and disinfectant (provided by the club) to wipe equipment upholstery clean after use as a courtesy to other members. Adjustments to the steam room, sauna, spa, heat, air conditioning, fans or other equipment are to be made by staff only. NO EXCEPTIONS!
NO SMOKING/GUM CHEWING In the interest of providing a healthy and safe environment for our members, this club adheres to a NO SMOKING/NO GUM CHEWING policy. The use of any type of tobacco products, including smokeless tobacco, within the club is prohibited. No in/out privileges will be given.
FOOD AND DRINKS Food is permitted only in designated areas and not inside the locker room or in any wet or exercise areas. You may carry beverages in covered plastic containers only during your visit; no glass containers are permitted in the club. Please properly dispose of all drinking containers and refuse in the trash receptacles. Alcoholic beverages are not permitted on the premises or grounds. Do not drink alcoholic beverages before using the club facilities.
SECURITY AND PRIVACY For the security of our members and staff, video and/or audio monitoring and recording equipment are in use in limited public areas. Any member information that is stored is for our use only. We never sell, rent, trade or treat casually your information or image. We understand and respect and protect your right to privacy. Cameras, or photo imaging and/or transmitting devices of any kind are prohibited. Cell phone use is restricted except for private area with door closed. Additionally we ask that your ringer be set to “silent.”
PERSONAL CONDUCT Persons who exhibit loud, aggressive, harmful, violent, disorderly, or disrespectful behavior towards members or staff, or behavior that is inappropriate or detrimental to the club’s environment, will be asked to leave the club. Members are subject to the control and guidance of the club's staff and must follow their instructions while in the club. Members agree to conduct themselves in a quiet and well-mannered fashion when in or about the club and not cause any disturbances or interfere with the safe use or enjoyment of the club by other members. Members shall not conduct, purchase or subscribe to any commercial business or activity on club premises or solicit other members for any reason without the club's prior written consent. Prostitution, (soliciting, propositioning, offerings), is strictly prohibited. Soliciting, requesting, offering, positioning or possessing any controlled substance either for personal use or for sale will result in immediate expulsion from the club without a refund and the authorities being notified. Under no circumstances shall members interfere with the club's conduct of its business. Any complaints (other than those of an emergency nature or requiring immediate attention by the club's personnel) shall be made directly to the manager, in private. Members, guests, and other invitees are required to comply with all Federal, State, and Local laws and regulations.
WAIVER AND RELEASE You agree that if you engage in any physical exercise or activity, or use any club equipment or facility on the premises, you do so at your own risk. You agree that you are voluntarily participating in activities and use of the facilities and premises (including the parking lot) and assume all risk of injury, illness, damage or loss to you or your property that might result, including, without limitation, any loss or theft of any personal property. You agree to release and discharge BBG Inc. BBG Health Club (and our affiliates, employees, agents, representatives, successors and assigns) from any and all claims or causes of action (known or unknown) arising out of our negligence. You acknowledge that you have carefully read this Waiver and Release and fully understand that it is a release of liability. You are waiving any right that you may have to bring a legal action to assert a claim against us for our negligence.
Your use of any club equipment is only allowed with the understanding that you know how to operate said club equipment and are able to do so with no risk of injury to yourself or any other individual in the club or outside the club. You assume SOLE LIABILITY for your use and operation of any club equipment and hereby indemnify the club and release the club and all affiliates from any liability that stems from failure to use the equipment in the proper manner (and at appropriate levels of resistance/weight) including but not limited to: muscle tears, broken bones, cardiac issues, sprains, or other damage to you or your person caused by the equipment. MEMBERS ARE EXPECTED TO KNOW HOW TO USE CLUB EQUIPMENT TO PERFORM EXERCISES WITH THE APPROPRIATE FORM, WEIGHT, RESISTANCE, VOLUME, ETC. SO AS NOT TO INJURE THEMSELVES AND ALL MEMBERS ASSUME ALL LIABILITY FOR ANY INJURIES SUSTAINED BY THEM.
ADDITIONAL RULES AND REGULATIONS We reserve the right to amend or alter these rules and regulations at any time in our sole discretion. All amendments to these rules and regulations are effective immediately. In accordance with your membership agreement and these rules, we may revoke or suspend your membership if you fail to follow the rules and regulations or for any reasons of nuisance, disturbance, or fraud.
By signing your membership card, you pledge to abide by the house rules and help make The BBG Health Club a pleasurable and safe club. By joining and entering BBG Health Club you affirm under penalty of perjury that if you are an agent or attorney of any government agency or branch, law enforcement agency or military agency or branch, that you are entering this establishment as a member and are doing so for your personal experience and enjoyment, and will not use any of this experience to harm BBG Inc., their managers, employees or members during or after your membership. If you have any questions, please feel free to consult any member of our staff for assistance.
BBG is a health and social club that allows like-minded men to work-out as well as provides a safe and comfortable environment to meet other like-minded men.
By Digital signing this agreement you certify that you are over the age of eighteen, have the capacity to enter into this agreement, and are in agreement and will abide by and are in acceptance of the rules and regulation of the club. You further agree that this is your electronic signature for a valid membership to the club.
Acceptance: N/A
